License

Subject to these Terms and your payment of the applicable fee, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the software for your own trading activity. You may not resell, redistribute, sublicense, rent, or share your license, nor reverse engineer, decompile, or attempt to extract source code except as permitted by law.

No affiliation with Topstep or any platform

Botfolio is independent software. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Topstep, TopstepX, ProjectX, or any brokerage, exchange, or trading platform. All product and company names are trademarks of their respective owners and are used for identification only.

Not financial advice

Botfolio is a software tool. Nothing provided by the software or this website constitutes financial, investment, legal, or tax advice, or a recommendation to buy, sell, or hold any instrument. You are solely responsible for your own trading decisions.

Trading risk disclaimer

Trading futures and other leveraged instruments involves substantial risk of loss and is not suitable for everyone. Automation does not guarantee profits and does not prevent losses. Past performance and historical or simulated results are not indicative of future results. You may lose some or all of your capital, and you trade entirely at your own risk.

Your responsibilities

You are responsible for:

• Complying with the rules, terms, and prohibited-conduct guidance of any platform or broker you connect to, including Topstep.
• Safeguarding your account credentials, API keys, and license keys.
• Supervising any automated activity and using available risk controls and emergency stops.
• Ensuring your use of the software is lawful in your jurisdiction.

Third-party services and fees

The software may connect to third-party platforms and services. Their availability, behavior, and terms are outside our control. Broker, market data, funded account, exchange, and platform fees are not included in your purchase and are your responsibility.

Payment and refunds

Prices are shown at checkout and may change. Payments are processed by third-party providers. Any refund eligibility will be described at the point of sale or upon request; except where required by law, license fees are otherwise non-refundable once a license key has been delivered.

Disclaimer of warranties

The software and website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or that it will achieve any particular result.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses, lost profits, or lost data, arising from or related to your use of the software or website. Our total liability for any claim will not exceed the amount you paid for the software in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses arising from your use of the software, your trading activity, or your violation of these Terms or any third-party rules.

Termination

We may suspend or terminate your license if you breach these Terms. Upon termination, you must stop using and delete the software. Sections that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the software or website after changes take effect constitutes acceptance.
